Abstract: The Intermodal Surface Transportation Efficiency Act (ISTEA) gives states greater authority to spend transportation dollars as they see fit. While many projects have been funded because of this breakthrough legislation, progress has been slow and funding unpredictable. Federal spending caps are limiting full release of ISTEA funds, which makes short- and long-term planning difficult for states. This article describes the slow erosion of ISTEA stemming from the unified budget approach, which means dedicated user fees making up the Highway Trust Fund are no longer managed outside the rest of the federal budget. Designations for the National Highway System (NHS), a portion of ISTEA, are being considered by the House of Representatives and the Senate. Appropriations for NHS must be decided by September 30, 1995.
