Abstract:On 16 October 2019, the European Commission (‘Commission’) adopted its first decision under Article 8 of Council Regulation (EC) No. 1/2003 (‘Regulation 1/2003’),1 imposing interim measures on Broadco...On 16 October 2019, the European Commission (‘Commission’) adopted its first decision under Article 8 of Council Regulation (EC) No. 1/2003 (‘Regulation 1/2003’),1 imposing interim measures on Broadcom Inc. (‘Broadcom’).2 By decision of 7 October 2020, the Commission made binding a commitments package submitted by Broadcom, which aimed at removing the preliminary concerns identified by the Commission. This article briefly summarises the content of Article 8 of Regulation 1/2003 and the debate concerning the effectiveness of antitrust enforcement, including the use of interim measures, in recent years. It then summarises the content of the interim measure and commitments decisions in the Broadcom case and formulates conclusions on the lessons learned in this case and the potential use of interim measures and commitments going forward.
