Title: Los límites a las actuaciones de obtención de información realizadas por la Inspección: ineficaces unos, inexistentes otros
Abstract: Este trabajo ha obtenido el 1.er Premio Estudios Financieros 2016 en la modalidad de Tributación. Una de las tareas asignadas por el artículo 141 de la Ley 58/2003, de 17 de diciembre, General Tributaria, a la Inspección de los Tributos es la realización de actuaciones de obtención de información con trascendencia tributaria, siguiendo los dictados de sus artículos 93 y 94. La ley trata, por tanto, de establecer vías, de tender puentes para que la información que resulte relevante en orden a la aplicación de los tributos cruce desde el lado de los obligados tributarios hasta la Administración. Evidentemente, no ha de tratarse de un trasvase indiscriminado de datos, de ahí que el ordenamiento perfile una serie de límites a la actuación administrativa dirigidos, en principio, al reconocimiento y salvaguarda de un conjunto de derechos fundamentales: derecho a la intimidad, al honor y a la no autoinculpación. La efectividad de tales límites frente a una Administración tributaria ávida de información centrará el objeto de nuestro estudio.
