Title: The historical antecedents of the rights to silence and the evolution of the adversarial trial system
Abstract: Die oorsprong van swygreg en privilegie teen selfinkriminasie is gewikkel in onsekerheid, welke
onsekerheid die gevolg is van regstegniese ooreenstemming tussen die aard en funksie van die
swygreg enersyds en die reg teen selfinkriminasie andersyds. Die tradisionele ontwikkeling van die
