Abstract: It is a necessary condition for the pursuit of virtually any human project that the subject has at least a minimal level of good health. The importance of a right to health is not, therefore, in issue and it is recognised in the fundamental documents of the human rights movement. The Universal Declaration sets out in Article 25 that: Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services … The International Covenant on Economic, Social and Cultural Rights recognises (Art.12) 'the right to enjoyment of the highest attainable standard of physical and mental health'.
