Charter based institutions have been established to hold individuals to account for crimes that constitute violations of human rights, and violations of international humanitarian law. The principal human rights treaties contain provisions on the establishment and functioning of institutions and procedures to oversee their implementation. The Human Rights Committee is established under article 28 of the Covenant, and is composed of 18 human rights experts who, although nominated by the State party of which they are nationals, serve in their personal capacity.
