Title: Der Verwaltungsakt in der Lehre Otto Mayers : staatstheoretische Grundlagen, dogmatische Ausgestaltung und deren verfassungsbedingte Vergänglichkeit
Abstract: In keinem Bereich ist der Einfluss Otto Mayers Verwaltungsrechtslehre heute noch einflussreicher als im Recht des Verwaltungsakts. Die bekannte Aussage Otto Mayers Verfassungsrecht vergeht, Verwaltungsrecht besteht wird hier eindrucksvoll bestatigt. Vor dem Hintergrund der gegenwartigen Verfassungslage kritisiert Reimund Schmidt-De Caluwe diesen Zustand. Er zeigt zunachst auf, dass das Verwaltungsrecht in seiner massgeblich von Mayer gegen Ende des 19. Jahrhunderts geformten Auspragung bis in die kleinsten Verastelungen hinein durch das Staatsverstandnis des Konstitutionalismus bestimmt war. Fur das Institut des Verwaltungsakts wird die Abhangigkeit der klassischen Lehre von obrigkeitsstaatlichen Pramissen sodann bis in seine dogmatischen Feinheiten dargestellt. Reimund Schmidt-De Caluwe geht es nicht darum, Mayers Verdienste um das deutsche Verwaltungsrecht in Frage zu stellen. Seine Kritik gilt vielmehr der heutigen Rechtslehre, die die Mayerschen Strukturen konserviert, ohne die Veranderungen der staats- und verfassungsrechtlichen Gegebenheiten hinreichend zu berucksichtigen. Otto Mayers System des Verwaltungsrechts, das in seiner Erfindung des Verwaltungsakts ihren typischen Ausdruck fand, konnte letztlich uber formal-rechtsstaatliche Ansatze nicht hinausfuhren, weil es auf einer absolutistisch und vorrechtlich begriffenen Staatsidee basierte. Ohne eine solche, heute indiskutable Verankerung verliert sein System und sein derzeit noch pragendes Verstandnis des Verwaltungsakts jeglichen Halt. Reimund Schmidt-De Caluwe pladiert deshalb dafur, das Recht des Verwaltungsakts auf demokratisch-rechtsstaatlicher Verfassungsgrundlage zu rekonstruieren.
