Title: Fundamentos Históricos da Lei 13.467/17. Uma investigação sobre as raízes do retrocesso
Abstract: Law 13.467/17, known as Labor Reform, changed the structure of the Consolidation of Labor Laws and qualitatively modified Labor Law in the direction of a trend towards the flexibilization of social rights.This work aims to provide the law researcher with an explanation for the setbacks established in this Law, seeking its foundations outside the legal system.It is in the history of contemporary Brazil, in the intricacies of the political, economic, social, and environmental crisis triggered in the country in recent years that we seek answers to explain Law 13.467/17.We start by briefly rescuing the context of the 2008 economic crisis and the wave of counter-reforms it caused.This work analyzes the period from 2015 to 2017 in Brazil, systematizing the understanding of various authors about the economy, the working class, the bourgeoisie and the middle classes, the institutional coup of 2016, the reactionary mobilizations that took to the streets of Brazil and the backstage of the national congress in the period.It is in this multidisciplinary approach that we seek to justify our working hypothesis: Law 13.467/17 is the result of a defeat of the working class, caused by complex factors that do not support a univocal motivation, hence the need to approach Brazilian reality in so many and diverse dimensions.Our approach is not limited to contemplative pessimism, but on the contrary, we start from the recognition that Labor Law is in motion, is directly related to the achievements and setbacks of the working class and therefore understanding the defeat is a decisive step to overcome it.
