Title: The theoretical and empirical relationship between legal pluralism and economic development
Abstract: Strong factual evidence exists from the rule of law, governance, and development literatures that law influences development. However, efforts to translate this into policy outcomes have not met expectations. The translation of law and development research into policy may be more successful by accounting for the reality of pluralism in many countries. Although some assumptions made by the legal pluralist literature seem contradictory to those of the law and development literature, both describe an empirical reality. As a preliminary step in advancing our understanding of how pluralism impacts economic development, I analyze the effects of legal pluralism on foreign direct investment (FDI). I find that a measure of pluralism has no impact on FDI. However, a measure of customary-dominant law is negatively associated with FDI. These findings suggest a nuanced relationship between legal pluralism and economic development and highlight a need for further examinations of how pluralism impacts development outcomes.
