Abstract: Abstract The Double Jeopardy Clause in the Fifth Amendment of the United States Constitution prevents the government from retrying a criminal defendant for the same criminal offense after jeopardy has attached. The history of this relatively simple proposition is explored along with its practical complexities in modern American jurisprudence. Additionally, case examples of the application of the Double Jeopardy Clause are provided.
