Title: Capitalism as Civilisation: A History of International Law, de Ntina Tzouvala
Abstract: La profesora Ntina Tzouvala es, en la actualidad, una de las académicas más destacadas en nuestra materia, por lo cual quisiera comenzar señalando, en primer lugar, que el libro titulado "Capitalism As Civilisation: A History of International Law", basado en su tesis doctoral, es, además de una lectura brillante sobre la historia del derecho internacional desde la vertiente marxista 1 , una referencia obligada en la historiografía reciente en los estudios iusinternacionalistas.En su obra, Tzouvala explora la noción de "estándar de civilización" como un patrón argumentativo sobre el derecho internacional 2 que persiste más allá del siglo XIX y que oscila en una tensión permanente entre dos extremos, que son la "logic of biology" (lógica de la biología), que supone la exclusión de lo no occidental por encontrarse fuera del modo de producción capitalista, y la "logic of improvement" (lógica del desarrollo), que encarna el llamado a las comunidades no occidentales a integrar el Occidente mediante la transformación capitalista 3 .Este esquema, marcado por la discriminación racial, feminización e infantilización 4 por parte de Occidente, produce una jerarquía inmutable en la argumentación jurídica internacional 5 .
