Abstract: This essay explores the increasingly tense relationship between the United States and the International Criminal Court (“ICC”). These tensions recently came to a head over the ICC Prosecutor’s request to open an investigation into war crimes and crimes against humanity committed in Afghanistan. Given that the investigation would certainly implicate U.S. military officials, the Trump administration responded aggressively, ultimately prompting the ICC Pre-Trial Chamber to reject the Prosecutor’s requested investigation and bend to U.S. pressures.
This essay traces the complicated history of the U.S. – ICC relationship and examines the background of and reasons for the Court’s decision denying the request for an investigation into Afghanistan. The essay concludes by shedding light on the significant and detrimental impacts this decision may ultimately have on the future of the ICC, U.S. foreign policy, and the victims of the tragic crimes committed in Afghanistan.
