Title: Judicial Policy-making and the Peculiar Function of Law
Abstract: The relationships among social values, legal rules and judging which comprise much of the study of jurisprudence is explored, paying particular attention to the mutual tensions these elements create in the practical operation of a legal system. The difficulties inherent in the use of abstract rules to vindicate social policies in concrete cases is reviewed.
