Abstract: Ute of the ICC.Next, it takes a new look at the development of the concept of genocide from its first formulation by the scholar Raphael Lemkin in 1944 through its codification in the Genocide Convention.It concludes that while the drafting history does not clearly mandate a knowledge-based understanding of genocidal intent, neither does it clearly support a purpose standard.Instead, the history reveals a vigorous and confused debate over the intent standard that remained alarmingly unresolved at the time of the Convention's adoption.
