The statement should be perceived as step forward in recognizing the rightful claims of one half of humanity, in identifying neglect of women’s rights as human rights violation and in drawing attention to the relationship between gender and human rights violations. The Supreme Court of India has interpreted a number of basic human rights of women in the light of fundamental rights guaranteed in Part III of the Constitution. These fundamental rights gone much beyond the American Bill of Rights. Judiciary in India has reiterated the Human Rights of women by filling the vacuum in municipal law by applying, wherever necessary, International instruments governing human rights.
