Title: Dispute resolution in the European energy sector
Abstract: In recent years, news relating to dispute resolution in the European energy sector has been dominated by a series of investor-State cases concerning investments in the renewable energy industry. This chapter demonstrates that the fair and equitable treatment (FET) standard has been interpreted as requiring Contracting States, in certain circumstances, to ensure the stability of their renewable energy incentive schemes. It provides summaries of the awards so far rendered in the European renewable energy cases under the Energy Charter Treaty (ECT). The chapter concludes with the lessons that may be drawn from those cases as to the scope of the protection offered under the FET standard in the context of regulatory change. More generally, investment treaties including, in particular, the ECT, have a significant role to play in supporting the stability of the energy sector in Europe. A stable energy investment framework benefits not only energy investors, but also States and energy consumers.
