Title: A Cidadania Submersa. O Trabalho Doméstico na Itália entre os Séculos XIX e XX
Abstract: O artigo retoma o tema da história do trabalho doméstico enquanto cidadania invisível, grande contradição da ordem jurídica burguesa que se afirma em torno da unificação do sujeito de direito: uma sociedade nivelada com base na igualdade entre cidadãos proprietários, em que não há mais lugar para a condição servil, ao menos em teoria. Em virtude da nítida separação entre família e trabalho, na família burguesa o trabalho doméstico se torna sempre mais uma prerrogativa feminina. Um trabalho sem direitos, fundado ainda sob uma ideia de benevolênciaque não pode ser contratualizada. O trabalho doméstico foi regulado na Itália em 1958, momento em que, na era da modernização social e do milagre econômico, as famílias encontraram sempre mais dificuldades para achar profissionais domésticos. O serviço doméstico, cada vez mais em declínio no plano social, reaparece nos anos noventa no trabalho de cuidadores dentro do fenômeno da assistência aos idosos não autossuficientes. Encontram-se, assim, duas debilidades que o direito vê somente em parte: a fragilidade e a solidão dos idosos de um lado, e a pobreza das cuidadoras que, na busca por um futuro melhor, aceitam uma condição fora dos parâmetros do direito do trabalho.
