Title: A Comparative Study on the Management System for the Public Utility of Private Investment Projects
Abstract: 민간투자법은 제2조 제1호에서 사회기반시설의 종류로 총 53개를 열거하고 있다. 상당히 광범위한 영역의 사회기반시설을 인정하고 있다. 그러나 이들이 모두 민간투자의 대상이 되는 사무인지에 대해서는 검토가 필요하다. 일본의 경우는 법률에서 개략적인 부분을 정하고, 운영과정에서 세부적인 결정을 하도록 하고 있다. 공적인 성격이 강한 시설에 대해서는 민간투자를 통한 신설과 증설도 중요하겠지만, 그 보다는 일단 국가나 지방자치단체의 공적자금으로 공공시설을 건설하고, 그 관리는 민관의 역량을 살릴 수 있도록 일본의 지정관리자제도를 이용하면 좋을 것으로 생각된다. 민간투자법이 사회기반시설의 민간투자를 법적으로 허용하는 이유는 공공성을 포기하는 것이 아니라, 공공성의 확장을 위한 것이라고 할 수 있으므로, 공공성을 훼손시키면서까지 민간투자의 장점을 유지하려고 해서는 안 된다. 일본은 1999년 9월 24일 ‘민간자금 등의 활용에 의한 공공시설 등의 정비 등의 촉진에 관한 법률(PFI법)을 제정하여 시행하고 있다. 이 법의 가장 큰 특징은 운영권제도를 둔 것이다. 공공시설의 운영과 관련하여 일본의 또 하나의 특징은, 지방자치법에 ’지정관리자제도‘를 두고 있다는 점이다. 운영권제도의 장점으로서는, ①운영권을 매각함으로써 기존 채무를 삭감할 수 있다는 점, ②재정부담 없이 공공사업을 운영할 수 있다는 점, ③관리자의 관여를 확보하면서 민간사업자의 노하우의 도입에 의한 효과적・효율적인 공공시설의 운영이 가능하다는 점, ④시장위험성의 이전이 가능하다는 점 등을 들 수 있을 것이다. 한편, 민간사업자 측면의 장점으로는, ①자신의 창의성과 연구를 통하여 이용요금 수입을 동반한 공공시설의 운영이 가능하고, ②운영권을 담보로 하여 자금조달이 가능하다는 점이다. 지정관리자제도는 PFI법의 시행으로 새롭게 주목 받고 있는 제도이다. 공공시설의 관리를 일반 주식회사를 포함한 민간 사업자에게도 수행하게 할 수 있는 ‘지정관리자제도’를 도입하는 지방자치법 개정이 2003년에 있었다. 지정관리자제도는 공공단체, 공공적 단체 및 지방자치단체의 출자법인만이 아니라, 출자법인 이외의 민간 영리기업도 포함하여 지방자치단체가 지정하는 자(지정관리자)가 공공시설의 관리를 대행할 수 있도록 한 제도이다(일본 지방자치법 제244조의2 제3항). 이는 적정한 관리를 확보할 구조를 마련한 다음, 수임자의 자격 제한을 철폐하고, 그 시설 서비스를 제공함에 있어 가장 적당한 사업자를 선정하여 주민서비스의 향상을 기하기 위한 제도이다. 일본은 2005년부터 지방자치법상의 지정관리자제도를 민간투자에도 활용하고 있다. 즉 공공시설의 관리를 민간전문가에게 맡김으로써 운영의 묘를 살려 경제적 활성화를 기대하고 있는 것이다. 민간투자사업의 성공을 위해서는 공공시설의 관리・운영에 관한 검토도 필요하다. 먼저, 민간투자사업의 경우 철저한 사후 검증이 필요하다는 점이다. 민간투자 사업의 각 추진 단계별 검증 주체, 방법 및 시기를 체계적으로 규정하여야 한다. 둘째, 지방자치단체가 사업시행자가 되는 사업의 경우 지방자치단체 내부의 통합적인 관리 시스템이 필요하다. 지방자치단체가 사업시행자가 되는 많은 사업이 국가보조금을 기반으로 하여 지방자치단체가 비용을 조달하는 방법을 취하고 있다. 이는 지방자치단체의 자율성을 저해하고, 책임감을 둔화시켜 도덕적 관리 부실로 이어질 우려가 있다. 과감한 재정분권을 통해, 지방자치단체가 자율적이고 책임감을 가지고 사업을 수행하고 민간투자를 유치할 수 있도록 제도적 정비도 검토되어야 한다.
