Title: DEVER DE FUNDAMENTAÇÃO E PRECEDENTES NO NOVO CPC: UMA ANÁLISE À LUZ DO MODELO CONSTITUCIONAL DE PROCESSO
Abstract: Este trabalho objetiva conjugar as regras de fundamentação impostas pelo Novo CPC com a sistemática de precedentes judiciais, a partir dos paradigmas do novo modelo constitucional de processo. Para tanto, são analisados os fundamentos principiológicos utilizados pelo legislador ordinário para a construção da dinâmica de precedentes disposta no novel diploma. Ademais, destacam-se as diferenças existentes entre o conceito de precedente e seus termos jurídicos assemelhados. No mesmo passo, estudam-se os elementos essenciais que compõe o precedente, mediante a separação da ratio decidendi e da obter dicta. Por fim, realiza-se um breve estudo do dever de fundamentação, concluindo-se que tal dever, que é um postulado constitucional, apresenta-se como imperativo ético e legitimador da atuação jurisdicional, observando a sua extrema relevância para o processo de formação do precedente judicial. A pesquisa adota o método dedutivo de abordagem. O tipo de pesquisa é documental e bibliográfica, a partir do conteúdo de livros e artigos científicos.
