Abstract: Die Aufgaben des Medizinischen Dienstes der Krankenversicherung (Medizinischer Dienst, MDK) sind in § 275 SGB V durch den Gesetzgeber festgelegt worden. Es handelt sich hierbei um den unabhängigen Beratungs- und Begutachtungsdienst der Gesetzlichen Krankenversicherung, dessen Ärzte gemäß § 275 Abs. 5 SGB V bei der Wahrnehmung ihrer medizinischen Aufgaben nur ihrem ärztlichen Gewissen unterworfen sind. Daher vertreten die Ärzte des MDK im Rahmen ihrer unabhängigen Begutachtung stationärer Krankenhausleistungen keinesfalls „die Seite der Kostenträger“, wie dies im Leserbrief des Kollegen Jäckel fälschlicherweise suggeriert wird, sondern nehmen gemäß ihrem gesetzlichen Auftrag eine unabhängige und unvoreingenommene gutachterliche Bewertung des medizinischen Sachverhalts vor [1]. Der Bundesgerichtshof hat aus diesem Grund in seiner Rechtsprechung unmissverständlich festgestellt, dass der bei einem MDK angestellte Arzt in Ausübung eines öffentlichen Amts handelt [2].
