Title: The Enforcement of American Punitive Damages in the European Union
Abstract: The enforcement of judgments is the third area of private international law in which the study of punitive damages is relevant. When an American court orders punitive damages against the defendant, he or she must pay the amount due to the plaintiff. If a debtor is unwilling to pay, the judgment needs to be enforced against his assets. When the debtor has no or insufficient assets in the jurisdiction where the judgment was rendered, enforcement needs to take place in a country where the judgment-debtor has assets. This chapter looks at the enforcement of United States punitive damages judgments in the European Union.
