Title: The Legitimate Justification of Expropriation: A Comparative Law and Governance Analysis by the Example of Third-Party Transfers for Economic Development
Abstract: Eigendom is een grondwettelijk beschermd recht. Daarom is een onteigening alleen rechtmatig indien zij een wettelijk erkende rechtvaardiging heeft. In de afgelopen decennia groeit het aantal onteigeningen ten behoeve van private bedrijven aanzienlijk. De overheid hoopt dat het private bedrijf een project uitvoert om banen en economische groei te creeren. De rechtvaardiging van dergelijke onteigeningen is zeer controversieel. Hun publieke voordelen zijn omstreden; zij begunstigen onmiddellijk private bedrijven; en zij leiden niet altijd tot het gewenste resultaat. Het proefschrift van Hoops is een vergelijkend onderzoek naar de voorwaarden waaronder onteigeningen voor economische ontwikkeling rechtmatig zijn in Nederland, Duitsland, New York en Zuid-Afrika. Hoops analyseert de regels waaraan de onteigening moet voldoen, de bevoegde overheidsorganen en de toepasselijke procedures. Om de kwaliteit van de voorwaarden te beoordelen vergelijkt Hoops ze met internationaal erkende standaards. I.g.v. afwijkingen doet hij aanbevelingen ter verbetering. Het proefschrift laat zien dat door private bedrijven geschapen economische ontwikkeling in alle onderzochte landen een legitiem doel is. Hoops toont hiernaast grote verschillen aan. Terwijl de Duitse wetgever moet beslissen of het project een legitiem doel dient, laten de andere stelsels dit over aan bestuursorganen. Niet noodzakelijke onteigeningen zijn in alle stelsels behalve Zuid-Afrika onrechtmatig. Behalve in Duitsland toetst de rechter de evenredigheid van de onteigening heel terughoudend. In New York en Zuid-Afrika kan het voorkomen dat het private bedrijf niet verplicht is om het project daadwerkelijk uit te voeren. Hoops betoogt ten slotte dat alle stelsels in menig opzicht hun recht moeten aanpassen om internationale standaards te bereiken.
