Title: ¿Pasa el test de convencionalidad el Art. 85.2 del código penal argentino que sanciona la interrupción del embarazo aún si la mujer lo decide voluntariamente en los tres primeros meses de gestación? Una sentencia brasileña con visión de género
Abstract: El comentario tiene por objetivo analizar los argumentos de la sentencia del 29/11/2016, de la sala I del Tribunal Supremo de Brasil, que decidió que penalizar la interrupción del embarazo, consentida por la mujer, practicada en los tres primeros meses de gestación, viola derechos fundamentales establecidos en la Constitución del Brasil y en las Convenciones Internacionales de Derechos Humanos. Cada uno de los argumentos se compara con los expuestos en la Argentina en casos similares con el fin de avanzar en la construcción de un “Derecho Constitucional común para América Latina” El análisis comparativo de la sentencia se estructura sobre los siguientes pilares: los antecedentes fácticos del caso; los requisitos constitucionales para que una conducta contraria a derecho merezca la respuesta penal del Estado; los derechos fundamentales de la mujer violados con la penalización en los tres primeros meses de gestación (autonomía, salud, derechos reproductivos, igualdad de género, igualdad en el ejercicio de los derechos económicos, sociales y culturales) El trabajo concluye con una exhortación para que los tribunales constitucionales de América Latina sigan el camino abierto por la sentencia brasileña mientras el legislador no se decida a despenalizar el aborto y a proveer asistencia médica a la mujer, tal como ha acontecido en la República del Uruguay
