Title: פסיביזם שיפוטי ומשפט פלילי פיקטיבי: על הרשעות בלתי-יסודיות ובעיית השקר המשפטי Judicial Passivism and Fictitious Criminal Law: Non-Elementary Convictions and the Problem of the Legal Lie
Abstract: תקציר בעברית: חרף האפשרות להעלות לא רק טיעונים עובדתיים בתיקם, אלא גם טיעונים משפטיים שמשליכים על האפשרות להרשיעם, נאשמים רבים מודים בבית המשפט. תגובתו המידית של בית המשפט היא הרשעתם, אף שייתכן למשל שיסודות העברה אינם עולים מכתב האישום. התנהלות כזו היא מגמה רחבה, תופעה שהמאמר מכנה משפט פלילי פיקטיבי. אף שהיא עולה בשלושת מישורי המשפט הפלילי – המהותי, הראייתי והדיוני – היא קשה במיוחד באשר למהותי והקוגנטי. כשאדם מודה ומורשע בעברה שיסודותיה אינם משתקפים מכתב האישום, עולות בעיות שונות: חוסר סמכות מהותית בהרשעתו, עוול לנאשם או לציבור בתיוגו הפלילי המסולף, ומה שהמאמר מכנה שקר משפטי, תוצר הנוגד את הדין. כאשר נאשמים אחרים באישומים דומים נוהגים באופן דומה, עלול להיווצר אפקט מעצב דין: ריבוי ההודאות וההרשעות האוטומטיות עלול להשליך בעקיפין על נאשמים עתידיים באישומים דומים. הסיכוי לזיכוי משפטי עתידי באישומים כאלו מצטמצם מאד עם כל הודאה והרשעה. המאמר מזהה את התופעה ומציע לה פתרונות מכיוונים שונים: התנהלות סנגוריאלית אסטרטגית, רפורמה חקיקתית, מודעות שיפוטית ותשומת לב אקדמית. על מערכת המשפט לעצב את הדין כעניין נורמטיבי ערכי ולא כתוצאה של מומנטום ודינמיקה בין תביעה לבין סנגורים.
English Abstract: Despite the possibility of making not only factual but also legal claims that may bring acquittal, many defendants plead guilty in court. The court's immediate reaction is convicting them, even though the indictment may not even reflect the elements of the crime. This conductance is a wide phenomenon the article designates fictitious Although it appears in all fields of law – the substantial, the procedural and the evidential – it is especially problematic regarding the substantial. When a defendant pleads guilty and is being convicted for an offense whose elements are not reflected by the indictment, various problems occur: the lack of substantial authority to convict, injustice to the defendant or to the public by false labeling, and what the article designates a criminal lie, a legal product which defies the law. When many defendants of similar indictments act as described, a law-forming effect may come to life: the multiplicity of guilt pleas and automatic convictions might affect future defendants. Every guilty plea and every conviction significantly narrow down the chances of future legal acquittal to such indictments. The article identifies this phenomenon and offers diverse solutions: strategic defense, statutory reform, judicial awareness and academic attention. The justice system should construct the law as a normative matter and not due to prosecution-defense dynamics and momentum.
