Abstract: Politics (πολιτικός/politikos) is the procedure of making decisions applying to all members of each group. Law and politics are two options/routes of the same entity and their detached existence is only a result of a human dualistic or pluralistic insight of the world. . Law is about system, order and discipline and the very raison d’etre of the nation-State is legal unity. The rule of law exists when the law is publicly known, applies equally to ordinary citizens and rulers, and where all are free to test and observe that universal application. The international rule of law is enveloped/ encircled with the essence of being a political term based on the national rule of law which is shaped by a real law context rather than the political affairs of state sovereignty. There is an obvious interference of politics above the rule of law leading to the emergence of the politics of law. Especially, the impact of politics above the law and the rule of law are higher in criminal law cases. It could be said that politics overrule the rule of law not only in international criminal law cases but also on national criminal law cases having an impact upon national and global political affairs.
