Title: The Meaning of the Supreme Court’s Decision on the Rejection of an Establishment Application for the Migrants’ Trade Union
Abstract: A group of 91 migrant workers, including undocumented workers, working in Seoul, Incheon and Gyeonggi Province organized the Migrants’ Trade Union (“ mtu ”) which is in the form of regional trade union on April 24, 2005. On May 3 of the same year, it submitted an establishment application for labor union accompanied by its bylaws to the Minister of Labor (now the Minister of Employment and Labor). This mtu case, which has been pending before the Supreme Court for eight years was decided to “dismiss the defendant’s appeal.” This case will probably be named as the longest pending case of the Supreme Court.
