Title: Rethinking water law: from principles to water codes
Abstract: This work sets out to find what can be done about global water problems from a legal point of view, and it aims to develop a coherent and unitary basis of water law. The new legal approach should be founded on a functional integration with different fields, together with the creation of a new water culture, based on rationality and solidarity. The development of a unified and coordinated field of law, devoted solely to water issues, is timely and necessary. So far, water law has primarily served a collection function, gathering statutes and regulations affecting water. It is time it took on a more active role as well, through necessary steps such as the identification of problems, priorities, and principles, the analysis of the present state of the discipline, and the proposal of solutions. Starting from general principles, and from an international water code made of something more than abstract declarations, national water codes can be adopted, in order to harmonize water law.
