Title: The Kosovo Opinion and Issues of International Responsibility
Abstract: The Kosovo advisory opinion of the International Court of Justice (henceforth ICJ or the Court) has been widely criticised for being too restrictive in its scope. The 'traditional' argument for remedial secession is based on a contrario interpretation of a passage from the Friendly Relations Declaration. Another responsibility issue which is raised by the Kosovo opinion of the Court is the qualification of the authors of the unilateral declaration of independence (UDI). The two issues examined are different in nature and may at first sight appear to be related only by the fact that both concern the law of international responsibility, and as such a distinct subject area of international law.
