Abstract: תקציר בעברית: לאחרונה הועלתה יוזמה להגביל (לצמצם) את השפיטות בבית המשפט העליון באמצעות חקיקה. סוגיית השפיטות אינה מוסדרת כיום בחוק אלא בהלכות שיפוטיות שפותחו במשך השנים על ידי בית המשפט העליון. היוזמה נועדה לשנות את מגמת הרחבת השפיטות בפסיקות בית המשפט העליון שהחלה באמצע שנות השמונים ולחזק את אמון הציבור בבית המשפט.במובנה המקורי השפיטות נועדה להיות מבחן סף פרוצדורלי המיושם כחלק מהפעלת שיקול דעת על מנת לסנן עתירות שאינן מתאימות לדיון בבית המשפט ולמנוע דיון לגופן. שימוש נרחב בדוקטרינת השפיטות על ידי בית המשפט כמבחן סף יביא למעשה לתוצאה דומה לזו של צמצום השפיטות בחקיקה, קרי: צמצום הביקורת השיפוטית בנושאים שהוגדרו כבלתי שפיטים.המאמר טוען כי דוקטרינת השפיטות המוסדית כפי שפותחה ויושמה על ידי בית המשפט העליון, במיוחד החל משנות השמונים של המאה העשרים, איבדה למעשה את זהותה ואת תפקידה המקוריים כמבחן סף לדיון בעתירות. קריאה בפסיקת בית המשפט העליון מגלה שלמרות הרטוריקה השיפוטית הממשיכה לעשות שימוש בביטויי אי שפיטות, בית המשפט דן בעתירות לגופן, ונימוקי אי השפיטות משמשים אותו כחלק ממכלול השיקולים לדחייתן. המאמר טוען שמבחינה עיונית אין זה נכון לכנות פרקטיקה שיפוטית זו כהפעלה של דוקטרינת שפיטות היות שאין המדובר בהפעלת מבחן סף פרוצדורלי ובהימנעות מדיון בנושאים המסווגים כבלתי שפיטים, ויש לראותה כחלק מתפיסה רחבה יותר של שיפוטי.המאמר תומך במגמה זו. כחלק מהערכה מחודשת של דוקטרינת השפיטות, נידונים טיעונים המועלים על ידי התומכים בצמצום השפיטות. המאמר מראה שטיעונים אלה אינם יכולים להצדיק את צמצום השפיטות בחקיקה או באמצעות הפעלת מבחן סף פרוצדורלי על ידי בית המשפט. עם זאת יש בטיעונים אלו כדי להצדיק ולחייב שיפוטי. במאמר נטען שזניחת השפיטות המוסדית כמבחן סף משקפת מעבר מפרוצדורה למהות והשימוש בשיקולי שפיטות כחלק מבחינה עניינית של עתירות ובמסגרת תפיסה של הוא מהלך נכון המתאים לשיטת משפט דמוקרטית מודרנית המעמידה במרכזה את זכויות האדם.הביטוי ריסון שיפוטי אינו זר לפסיקה ולכתיבה האקדמית בישראל אולם משמעותו טרם נבחנה בהרחבה. המאמר מציג עקרונות מרכזיים העומדים בבסיסה של דוקטרינת בתחומי המשפט הציבורי: תפיסה שיפוטית המכירה במגבלות הכוח, הידע והתפקיד של בית המשפט, הבאה לידי ביטוי ברטוריקה שיפוטית מתונה, בהעברת מסר של כבוד לרשויות השלטון האחרות, בהחצנה של מקרים שאינם מתאימים לדיון משפטי ובצמצום השימוש בעילת הסבירות. מרכיבים אלו אינם מייצגים את כל ביטויי הריסון השיפוטי ויש מקום להמשיך ולפתח את הדיון במהותו של שיפוטי. המאמר טוען שיישום דוקטרינה זו על ידי בית המשפט העליון עשוי לתרום לשיקום מעמדו הציבורי של בית המשפט, לענות למבקריו מהזירה הפוליטית ומהאקדמיה ולסייע להשבת האמון בו.English Abstract: Recently suggestions have been made to limit justiciability in the Israel Supreme Court through legislation. Until now justiciability has been regulated by case law, not statute. The suggestions have aimed to change the pattern of Supreme Court rulings on justiciability beginning in the 1980s extending justiciability, and to restore public trust in the Court.Originally justiciability meant to serve as a procedural threshold test implemented through discretion in order to filter out petitions unsuitable for court hearings and to prevent review of their substance. An extensive use of the justiciability doctrine as a threshold test by the court would bring to the same result that limiting justiciability by statute would bring to, that is reducing review in areas which have been declared unjusticiable.The article claims that the doctrine of institutional justiciability which has been developed and implemented by the Supreme Court since the 1980s has lost its original nature and role as a procedural threshold test. Reading the case law of the Supreme Court reveals that notwithstanding the rhetoric which continues to employ the language of unjusticiability, the Court in fact reviews the substance of petitions and unjusticiability is used as part of the reasons for denying petitions. The article claims that conceptually it is wrong to treat this practice as an implementation of justiciability doctrine because the Court is not employing a procedural threshold test and is not refraining from reviewing issues which have been categorized as unjusticiable. It is argued that the Court's practice should be seen as an exercise of which takes into account, inter alia, considerations of justiciability.The article supports this trend. It reevaluates the justiciability doctrine and discusses the arguments brought up by supporters of limited justiciability. It shows that these arguments cannot justify the limitation of justiciability either by legislation or by the implementation of a procedural threshold test by the Court. However it concedes that these arguments justify and compel restraint. It is argued that the abandonment of institutional justiciability as a procedural threshold test reflects a transition from procedure to substance, and that the use of justiciability considerations as a part of a substantive review of petitions in accordance with a conception of is a correct move suitable for a modern democratic legal system which put human rights at its heart.The term judicial restraint is not new to and academic writing in Israel but its meaning has not yet been considered in depth. The article presents key principles for in public law. That would require a attitude which recognizes that the Court's power, knowledge, and role are not without limitations; a moderate rhetoric; respect to other government authorities; the externalization of cases unsuitable for legal ruling; and a reduction in the use of unreasonableness as a ground for review. These principles do not exhaust all expressions of and there is room for continued discussion on the nature and meaning of restraint. It is suggested that adherence to this attitude might contribute to restore public trust in the Court and to answer criticism from the political arena and academia.
