Title: On the Inherence of Intellectual Property Rights:A Discussion with Theories of the Intellectual Property Cost,Consideration and Benefit Balance
Abstract: Intellectual Property is inherently originated from knowledge production process under given social production relationships,and is neither resulted from the process of knowledge circulation or diffusion,nor groundlessly made from State laws.Completely restoration of intellectual property rights is a natural law.The monopoly in the process of knowledge circulation or diffusion is not resulted from property rights,but resulted from the insufficiencies of knowledge investment,production and supply just because intellectual property rights are not got full respect and protection.Completely different from the theories of intellectual property cost,consideration and benefit balance that try to forcedly restrict,consider and balance intellectual property rights by laws,the theory of intellectual property rights born from production guided by the thinking method of Marxism,conclude that the intellectual property rights are neither costs to society,nor the results created by laws according to a given consideration term or the principle of benefit balance,but are a part of necessary wealth to social development that originate from knowledge production process.
