Title: Criminal law should respond rationally to "risk society"
Abstract: When discussing the countermeasures of criminal law to a risk society,to a certain extent,our circle of criminal law have deviated from the category of Baker's risk society and have expanded the scope of risk.For the above social problems,the claim that criminal law should strengthen crime,expand the scope of perilous criminals and increase administrative criminals is not appropriate.Criminal law should keep its own austerity and should not arbitrarily expand the scope of adjustment.Instead,we should give full play to the regulating function of other social norms,which,along with criminal law together,safeguards the good operation of social order.
