Title: Real-right Law Analyses of Collective-owned Enterprises in Urban Areas
Abstract: From the perspective of historical development of collective-owned enterprises, their ownership has experienced three stages, i.e., cooperative group ownership, state ownership and enterprise ownership. As to allocation mode, the dividend of shareholders has ever been prohibited and reopened. Forms of enterprise have changed from cooperative group to corporate juridical person. In the background of market economy system, ownership established according to tripartite division exists only in a political sense. The uncertain and non-scientifi c concept of collective brings about confusion of concepts when enterprises apply to related civil laws. The concept of collective is not a legal concept, which hinders the establishment of property ownership of collective-owned enterprises in urban area according to basic principles of Real-right Law. The exclusive solution is to state explicitly that enterprise as a legal person is the subject in Real-right Law so as to solve the confusions.
