Title: Analysis of Commercial Credit and Property Right Relationship:Centering on Ownership System
Abstract: The commercial credit is a cooperation relationship in the process of commercial dealings. The major obstacles in its formulation and expansion come from the asymmetry of message between the dealers. There exists complicated reciprocity between the commercial credit and the property right. On the one hand, the property right, as the regulation tool employed to overcome the message asymmetry, is the foundation of the commercial credit. On the other hand, the objective credit demand in the process of commercial dealings propels the transformation in the system of property right. Different historical forms of the ownership right, as the core of the property right system, are relevant to the situations of the social commercial credit. From the perspective of the history of the property law, the rise of the individual property system is its process of being adapted to the credit demand of commercial dealings.
