Title: Research on the Trend of Liberalization of Modern International Air Law
Abstract: Liberalization,as a value orientation of lex ferenda,is gradually reflected in positive international air law.This article mainly analyzes the trend of liberalization in the field of international air law from the perspectives of bilateral,regional,multilateral and the WTO legal systems.At the bilateral level,the trend of liberalization becomes more and more apparent from the Bermuda Agreement to the liberalized agreements signed by United States,although bilateral legal system established by the 1944 Chicago Convention is substantially a kind of trade protectionism.Furthermore,the highest level of liberalization had been reflected from the US-EU agreement and the Sino-US agreement in 2007.At the regional level,the movement of liberalization in the field of air law is also very apparent in European Union and the Asia-Pacific region.At the multilateral level,the trend of liberalization is promoted by air-alliance and ICAO in practice,although the range is very limited.At the WTO level,some WTO rules begin to regulate very less issues arising from air transportation,specially the Trade Policy Review Mechanism(TPRM)can facilitate the development of liberalization in the field of WTO aviation legislations.
