Title: The Intrinsic Relationship Between Canon Law and Roman Law in Europe
Abstract: A good understanding of the Roman law is essential to research on the canon law,because the origin of the medieval Roman law was merged with that of the canon law.The theory of utrumqueius is considered to be based on a correct understanding of the canon law.The formation of western legal traditions benefited considerably from the contributions made by the canon law jurists,which can be proved by the traditional analysis by Isidore of Seville of works by ecclesiastical leaders during the early revival of Catholicism and Gratian's Decretum,which was inherited from Codex Theodosianus and Justinian's Corpus Juris Civilis.From the history of the western law,we can see that secular law had been patterned on canon law,which is a fundamental principle of the western legal tradition.It is concluded that the legal culture in Europe is one under the utrumqueius influence of Roman law and canon law.
