Title: On the Significance of ADR for Reshaping the Alternative Dispute Resolution System in China
Abstract: ADR is a mechanism of alternative dispute resolution which is a new force suddenly coming to the fore in the past 30 years. It is the general term of various dispute dissolution methods that are not against mandatory rules of laws, selected independently and controlled by the parties to the dispute, and substitute for litigation proceedings. ADR possesses the function of resolving disputes flexibly, distributing judicial resources reasonably, and reducing the cost of dispute resolution. Because of the factors concerning Chinese traditional legal culture and the quite great affinity of ADR, it possesses great realistic significance to introduce the advanced experience of ADR of foreign countries to reshape the alternative dispute resolution system in China.
