Title: Legal protection of human rights in state of emergency
Abstract: When a country is in a state of emergency,how to maximize the protection of human rights at the same time of derogating human rights for the public interest is an important proposition in the international community.The paper,from the perspective of International Human Rights Law,based on the analysis of the emergent state in new era and the connotation of human rights,carried out an argument on the relationship between the human rights under the protection of three major international conventions and the derogation of human rights,and put forward a conclusion that protection of human rights in the state of emergency should be achieved through two dimensions which include strict implementation of international obligations and further improvement of monitoring process.
