Title: Conflict of Laws of Matrimonial Property in Cross-Strait and Solutions
Abstract: Mainland China and Taiwan have been prohibited from contact for several decades,and formed in different law districts,resulting in a special cross-strait inter-regional conflict of laws,how to resolve it has become an important issue of cross-strait relations.Taiwan promulgated the Act Governing Relations Between The People Of The Taiwan And The Mainland Area in 1992 and revised the Governing the Application of Laws to Civil Matters Involving Foreign Elements in 2010.At the same time Mainland China enacted the of the Application of Law for Foreign-related Civil Relations of the People's Republic of China. These are the main basis to resolve inter-regional conflict of laws in cross-strait.In this paper,we compared and analyzed the inter-regional conflict of laws based on these three laws and try to make some suggestions.Hope this study helps reasonably resolve cross-strait marital property disputes,better protect reasonable interests of both sides,and contribute to the harmonious development of cross-strait relations.
