Title: On Whom the Power of Administrative Enforcement Shall Belong to
Abstract: The theorical researches and law-making practices of administrative law of China are developed quiet late. Relative theories from Chinese administrative law science are not mature enough. Especially, there are considerably different viewpoints about the question of whom shall take the power of administrative enforcement. There is no a standard “Administrative Enforcement Act” issued by the law-making authority of China, which can not provide a set of united regulations for administrative execution activities. This is quiet not fit for goal of “rule by law, administration by law” raised by the Chinese government. So, it is necessary to make a further study on this question and its relative problems.
