Title: A Discussion on the Ownership of the Depositing Fund and Its Interests of the Third Party Payment Platform——With Pay Treasure as the sample
Abstract: As the packaged technology for the E-commerce,the third-party payment platform brought new problems to the property law.For example,the ownership of the depositing fund and its interests which are resulting from the transaction payment delay and finally are in the hands of the third-party payment operators is a focus of the dispute.This paper tries to explain with Pay Treasure as the sample that the depositing fund and its interests constitute the trust property of consumers which cannot be possessed and used by the third-party payment platform.In addition,taking into account the high administrative costs of distributing the interests to consumers,we should use the experience of the new stock purchase transactions for reference.That is,the interests of the depositing fund should be placed under the consumer protection organizations as a specific fund origin.If so,the theoretical self-sufficiency of the ownership of the depositing fund would be realized and the practical protection to consumer interests would also be promoted.
