Abstract: The principle that all criminal behavior is made by statute is one of the three fundamental principles of modern criminal law.Its significance lies in giving a restriction to the country's penalty and defending civil liberty and human rights,so as to make it clear for state judicial departments to keep civil freedom when executing penalty.In essence,this principle reflects the issue of interpretation of criminal law for application,that is,the legitimacy of criminal law.Around this issue exists the dispute between empiricism,represented by Max Weber,and normalism,represented by Habermas.They dwelt on this issue and clarified the legitimacy and functions of interpretation of criminal law for application.
