But it is legislative fault that it couldn't be taken as the crime of shamming registered trademark according to the principle of crime-penalty legalism. Thus there is every necessity to perfect the corresponding legislation: the crime of shamming registered trademark is a critical act, in which, in violation the trademark management law of the country, someone uses the trademark identical to others' on the same commodities or uses his own trademark on others' commodities personally without the trademarker' permission.
