Title: Study on Nominal Damages in Common Law System
Abstract: As an important rule of torts in common law system,nominal damages may be awarded against defendant who has committed tort which is actionable per se.There are two circumstances that nominal damages may be awarded,one is that no loss has been suffered by the claimant,the other is that the necessary evidence as to the specific loss is not given.Nominal damages is different from substantial minimum damages and is sometimes awarded coupling with punitive damages.The functions of nominal damages are for the confirmation of the plaintiff's individual reputation and of the right,and the provision of a mere peg on which to hang costs.
