Title: Explanation on Formation of Knowledge System of Modern Free Evaluation of Evidence in Qing Dynasty
Abstract: The evolution of knowledge about the free evaluation of evidence law in the late Qing Dynasty,has experienced aNew Dealbefore transmission and the New Dealperiod,the creation of the introduction of two stages.BeforeNew Deal,only some introduction of the concept to China,just like a kind ofthe otherlegal knowledge discourse,which is simple and still a foreign factor.After that period,the knowledge of free evaluation of evidence law has internalizationed gradually,as part of thenativelegal knowledge.To the late Qing Dynasty,as the core of modern evidence law,the free evaluation of evidence is obtained in the two procedural law draft,although not timely implementation,but became the model to the Republic of China,as the source of modern Chinese evidence law knowledge.Rearrange the Qing Dynasty the source of knowledge about the free evaluation of evidence,will not only help to break through theimpact response modeltheory and the type of the related study limitations,but also find supporting for the research of the history of free evaluation of evidence in the present.
