Title: The Role and Function of the Court in the Land Acquisition——From the Perspective of Regulation on the Expropriation of Buildings on State-owned Land and Compensation
Abstract: The public interest in land expropriation property determines the court can and should intervene in it,and play its justice and oversight functions. In land acquisition,the court is the judiciary to safeguard the public interest,the supervisory authority to oversee the administrative act,judicial relief personal interests. The requisitioned is conferred the corresponding administrative relief and judicial remedies by Requisition and Compensation Ordinance of Housing on State-owned Land,which is progressive. However,either from forced evictions,brutal demolition judicial demolitions perspective,or from the perspective of requisitioned relief mechanism and public interest litigation,there are many imperfections in Requisition and Compensation Ordinance of Housing on State-owned Land. We should further transform the concept of government administration,expand the scope of judicial review,establish and improve the system of public interest litigation,strengthening procuratorial supervision,to play the proper function of the court in the land expropriation.
