Title: On the Non-Judicial Social Governance of the Court System
Abstract: The court system of China has a distinct non-judicial feature in its participation in the social governance,which mainly displays as three types in practice: reclusive governance,mismatching governance and cross-border governance. The causes of this phenomenon could be demonstrated from three aspects: the governing authorities,governmental apparatus and the historical process of governance. Current non-judicial governance of the court system aims at the correction of the negative function caused by judicial governance, and the initiative to enhance the status of judicial power and intention of improving judicial efficiency. However,the court's involvement of the non-judicial social governance raises antinomy in three aspects: information, instrument and efficiency,which requires the optimization in practice.
