Abstract:Due to the existence of transaction cost,property rights cannot be defined completely both from the angles of legal property rights and economic property rights.Based on the analysis and comparison of...Due to the existence of transaction cost,property rights cannot be defined completely both from the angles of legal property rights and economic property rights.Based on the analysis and comparison of Barzel’s public domain of property rights and Demsetz’s thought of property right deficit,the paper proposes an analytic framework of property right public domain by combining and extending the two thoughts,and the framework is classified into six domains including attribute public domain,technical public domain,legal public domain,national public domain,individual public domain and restrictive public domain.According to the studies above,the paper elaborates the internal mechanism and the inner structure of incomplete definition of property rights,the process of clarifying the definition of property right,as well as the principles of property right definition,and the attributes and value of incomplete definition of property rights.The authors point out that subject behavior derived from public domain,resource allocation effects,income distribution effects and governance model,and historical performance are the future prospects of the study.Read More
