Abstract: There are nuances between traditional Chinese value notions about Justice and those of the Western. Traditional Chinese thinking understands beings from oughtness, while the Western tradition reaches oughtnesess through studying beings. The former pursuit justice from a moral perspective, while the latter reaches justice by the rule of law. The differences between these two approaches cannot explain all the internal conflicts lying within the concept of justice, which requests some re-defining the concept. This paper studies the historical practice of mankind in pursuit of justice and suggests a new definition of the concept of justice, i.e., not to see justice as an isolated concept that can be defined independently from freedom and fairness, but to address the following reality: all the issues of justice that we have encountered are actually problems of freedom and fairness. Thus, in reality there are two different types of value notions about justice: justice of freedom, and justice of fairness.The justice of freedom has been proved by the history and development of capitalism, while the justice offairness is what socialist ideology pursuits as its fundamental value. The interrelationship between these notions is historical and evolving rather than in conflict. The cultural diversification of contemporary world need and might be able to reach some new common view on how to realize the justice of fairness.
