Title: The Process of Codification of Private International Law
Abstract: When our country is drafting and formulating code of private international law positively, it is necessary to use the advanced experience in legislation for reference. To summarize up the existing experience in legislation needs to grasp some of the most basic and important problems in the course of codifying private international law. The core content of it is to distinguish between traditional and modern developing tendency, to adhere to principle of protection of private interests and realize certainty stability and predictability in application of law, to accommodate the opposing values about conflict justice and substantial justice, and to choose and use jurisdiction-selecting rules or content/result-oriented rules and how to ensure the proper resolution of dispute in choice of law. They decide the basic system and material content of legislation
