Title: The Ethical Interpretation Theory in Criminal Law
Abstract: Interpretation of criminal law heavily relies upon the values and directive thoughts chosen by people while they are viewing and applying specific statutory sections.To this point,unfortunately,none of the theories has offered us correct and simple answer.This paper advances an ethical interpretation theory which advocates that the best way to interpret criminal law is to choose and apply to the text the meaning that is most consistent with the public's judgment of evils.Both the liberal interpretation of crime and narrow interpretation of crime, that is popular now,are fallible.Further,this paper maintains that so long as a criminal law is ethically interpreted, neither the identity of the interpreter nor the method of interpretation is of concern.
